Crime Gun Tracing Modernization Act...

Post by awalker1829 »

Another Bill to oppose. Introduced by Sen. Bill Nelson (D), Fla. This bill proposes mandating that the National Tracing Center searchable databases of all records within its possession of the importation, production, shipment, receipt, sale or disposition of firearms required to be submitted to BATFE under Section 923, Title 18 USC.FFLs would be required to establish and maintain searchable electronic databases accessible to NTC within three years. The database would be searchable only by the descriptive information of the gun and the database shall not be electronically searchable by personal identifying information.

This would most definitely permit the NTC to conduct warrantless searches of private business records in violation of the Fourth Amendment and would be rife for abuse. I have already written my Senators to oppose the legislation. Presently, the Bill does not have a Bill Number assigned, so the only way to refer to it is by the name in the subject line.

FFL holders are already subject to warrantless searches anyway, who else would this affect? Various alphabet soup agencies can drop in unannounced and check your 4473's. Most make appointments, but I've never seen a warrant presented any of the few times the shops I've worked in co-operated with both local and Federal agencies.

It took several re-readings of this sentence to get the meaning of it.

Fixed.

It would seem manufacturers and importers should be opposing this more than your average 01 FFL,though I suspect they too are subject to the same searches.

I honestly don't see how that could improve much regarding crime.

This is a proposal to establish what is essentially a national firearms registry database. No good can come from that......

That’s basically what this is. Of course, once a gun hits the secondary market, the information that BATFE has becomes pretty much useless.

This is true.......until they succeed in eliminating all private transfers, then every transfer of ownership will be logged via the 4473. (assuming we law-abiding citizens will be good sheep and perform all transfers above board)
