Laws for private sale of Mosins in NY
Laws for private sale of Mosins in NY
I have three Mosins that I am looking to sell. I live in the peoples republic of New York State. Anyone familiar with the laws that apply to private sales? I find all kinds of conflicting info online. I would rather not break any laws or SAFE act rules selling these. Thanks for any help.
Re: Laws for private sale of Mosins in NY

It is legal for any citizen of the U.S. to ship a rifle thru the U.S. post office, as stated to me by a 25 yr. veteran Postal clerk.....

No C&R license. I would leave this left wing hell hole of a state in a minute if I didnt have three grown kids living here.

I live in NY and I'm a C&R. Be happy to take a look at them and see if we can solve this whole problemo for ya!

It's some of the people that suck here not the land. If we could be free of NYC the state would rapidly improve. If you sell them inside the state face to face to a non FFL holder then you have to pay an 001 FFL dealer to handle the transfer for you with background check. You can sell them to a Federally Licensed FFL holder by mail with no problem. List them in the boards for sale section, you will need a copy of the buyers current FFL, either 001, or 003 signed in ink in your possession before you can ship the rifle to them. You must ship only to the address listed on the FFLkaz1961 wrote:No C&R license. I would leave this left wing hell hole of a state in a minute if I didnt have three grown kids living here.
Leave it as it is. The ages have been at work on it and man can only mar it.

When you have a question regarding the firearms laws of your state it's best if you ask the BATFE, or contact the NRA about laws specific to your state. The Postal Service is not in charge of US state or federal firearms laws, and not expected to be an expert on them no matter how many years in service, and this is an area were if you screw up you can go to jail.steelbuttplate wrote:It is legal for any citizen of the U.S. to ship a rifle thru the U.S. post office, as stated to me by a 25 yr. veteran Postal clerk.....

You can ship long guns via USPS to any "licensed individual" in another state UNLESS that state has laws that restrict it.

I've been saying that for a while about nyc. Moved up from pa. Sucks cause I'm close enough to border I could have commuted but all prices of land etc were crazy with the gas drilling.Junk Yard Dog wrote:It's some of the people that suck here not the land. To protect yourself from the government I would ask a FFL 01 dealer to sell your firearms. If you make a mistake you could go to jail. The government protects itself not the citizens.

Most buys I have made we meet at an FFL and they inspect and usually charge about $10 to do the NICs and transfer. It's pretty quick and easy. Cabelas or gander mountain or a local range all do it fast and easy.
Re: RE: Re: Laws for private sale of Mosins in NY
$10 transfer and NICS? Where are you located? NJ charges FFL01 $12.50 just for NICS. Dealers in turn charge $40-$100 for transfer & NICS with most being right around $75. NJ doesn't recognize C&R. If they did I would have saved at least $3,000 in fees over the last few years. Even at $10 I would have saved a couple grand.Eryck65 wrote:Most buys I have made we meet at an FFL and they inspect and usually charge about $10 to do the NICs and transfer. The only thing we have going for us is long gun or handgun transfer FTF NJ Resident to Resident dealer is not needed. Long gun fill out certificate of eligibility and keep on file. Handgun fill out Permit to Purchase which is in quadruplicate buyer and seller get a copy, one copy sent to NJSP and one to local PD. I'm sure the Dems will change this the first chance they get.
PA I believe handguns have to go through FFL.
NJ to PA resident or vice versa in PA or NJ long gun transfer allowed, but has to be done by FFL. Is it the same in NY?
What about handgun transfers? Are they allowed non resident to resident? I think they are, but transfer has to take place in buyer's state and done through FFL in NY, NJ, or PA.
Not sure about C&R. Can non resident transfer to C&R long gun or handgun in NY, NJ, or PA?
Shipping long gun or handgun is allowed by non licensed individuals to FFL01 for them to transfer to buyer. Handguns can not be shipped via USPS by non licensed individuals. They can be shipped UPS but must ship via next day. Long guns can ship via either through normal ground or priority by non licensed individuals to FFL01 or 03.
I know long guns can ship direct to C&R holder by non licensed individuals, but what about C&R handguns?
Just curious about the Tri-State Area Laws.

Really? That sucks, Can other NJ residents on the board corroborate this? C&R is a Federal License so what say does the state have? Just wondering......capt14k wrote:NJ doesn't recognize C&R.

You can get a C&R License living in NJ, but you can't do anything with it.thughes wrote:Really? That sucks, Can other NJ residents on the board corroborate this? C&R is a Federal License so what say does the state have? Just wondering......capt14k wrote:NJ doesn't recognize C&R.

So you can't buy a C&R rifle from SOG, J&G, AIM, etc. with your C&R and have it shipped to your door? And how would any of the NJ authorities know if you did? Have you tried to purchase from an on-line retailer and been told "no" because you live in NJ?capt14k wrote:You can get a C&R License living in NJ, but you can't do anything with it.
Not trolling here, honestly want to understand the how and why.
Re: RE: Re: RE: Re: RE: Re: Laws for private sale of Mosins in NY
No you can not. All firearms must go through FFL01. That includes non firearms such as antique black powder and bb guns. Even worse you need to waste a Permit to Purchase if you want a BB Pistol or Matchlock Pistol shipped into NJ, and you can't buy a handgun for 30 days. As I said the only thing we have over any other state is the FTF transfers without NICS or FFL. Otherwise NJ Firearms Laws Suck.thughes wrote:So you can't buy a C&R rifle from SOG, J&G, AIM, etc. with your C&R and have it shipped to your door?
